Sagemitra is a mental health and wellbeing platform offering individual therapy, group therapy, and support group services on a direct-to-consumer (B2C) basis. We are committed to protecting the privacy, dignity, and confidentiality of every individual who engages with our platform.
This Privacy Policy outlines how we collect, use, store, and protect your information in accordance with applicable Indian laws, including principles aligned with the Mental Healthcare Act, 2017 and the Digital Personal Data Protection Act, 2023.
2.Scope of services
- Sagemitra provides non-emergency mental health support services.
- This platform is not a crisis helpline and must not be used during mental health emergencies. See the helplines at the top of this page if you need immediate help.
- Services are intended for individuals aged 18 years and above.
- Individuals below 18 may access services only with parental or guardian consent, and must use a parent or guardian account.
3.Information we collect
During onboarding and service usage, we may collect:
- Personal identification details (name, age, contact information)
- Emergency contact details (mandatory)
- Mental health history (shared voluntarily)
- Session-related notes (maintained by therapists)
You have the right to:
- Access and modify your data
- Request deletion of your data after 5 years from the start of service usage, subject to applicable law

4.Data usage and access
- All personal and therapy-related information is accessible only to the therapist team directly involved in providing your care, and the minimum Sagemitra operations staff required to run the platform.
- Sagemitra does not record therapy sessions.
- Sagemitra does not sell, rent, or trade your data with third parties for marketing.
- Service providers we use (e.g. video infrastructure, payment gateways, email) process limited data strictly as required to deliver the service, under signed Data Processing Agreements.
5.Confidentiality and its limits
We maintain strict confidentiality of all client information. However, confidentiality may be lawfully breached in the following circumstances:
- Risk of harm to self or others
- Disclosure related to child sexual abuse, under applicable child protection laws including the POCSO Act, 2012
- Homicidal intent
- Terrorist intent or threats to public safety
In such cases:
- Information will be escalated to the relevant legal authorities
- Sagemitra is not obligated to maintain confidentiality where doing so would be unlawful or unsafe
6.Data protection and legal compliance
Sagemitra adheres to ethical and legal standards inspired by the Mental Healthcare Act, 2017, including:
- Respecting client confidentiality
- Ensuring informed consent before any clinical engagement
- Protecting sensitive mental health data as Sensitive Personal Data under the DPDP Act, 2023
- Limiting data access strictly to relevant professionals
- Encryption of data in transit and at rest
7.Data retention
- Client data is retained securely for up to 5 years from the date of onboarding, in line with clinical record-keeping norms.
- You may request data deletion after this period, subject to applicable legal and regulatory retention requirements.
- Where the law requires longer retention (for example, financial records under tax law), only the legally mandated subset is retained.
8.Emergency contact requirement
- Providing an emergency contact person is mandatory.
- This contact will only be used in situations involving risk to your safety or the safety of others.
- You are responsible for ensuring the emergency contact details you provide are accurate and up to date.
9.Limitation of services
- Sagemitra does not provide emergency or crisis intervention.
- The platform cannot replace hospitalisation, psychiatric emergency care, or immediate medical intervention.
- In a crisis, contact local emergency services on 112 or one of the helplines listed at the top of this page.
10.Therapist responsibility disclaimer
- Therapists on Sagemitra operate as independent practitioners, not employees of Sagemitra.
- Any therapeutic approach, advice, or intervention is the sole responsibility of the treating therapist.
- Sagemitra acts only as a facilitating platform and does not assume liability for therapist conduct or clinical outcomes.
- All therapists are verified for valid RCI (Rehabilitation Council of India) registration where applicable, before being onboarded.
11.Breach of confidentiality — platform responsibility
In the event of a necessary breach of confidentiality:
- Sagemitra is obligated to prioritise client and public safety.
- We will take appropriate legal and ethical steps, including informing relevant authorities, documenting the incident, and informing the client when appropriate to do so.
Failure to act in such cases may carry legal consequences for the platform; therefore, Sagemitra reserves the right to act decisively in these scenarios.
12.User consent
By using Sagemitra, you:
- Acknowledge and agree to this Privacy Policy
- Provide informed consent for data collection and usage
- Accept the limitations of confidentiality and the scope of services described above
Your consent is a separate, explicit action and may be withdrawn at any time by writing to support@sagemitra.com. Withdrawing consent will end your active services on the platform.
13.Updates to this policy
Sagemitra reserves the right to update this Privacy Policy. Significant changes will be communicated to registered users by email and reflected on this page. Continued use of the platform after an update constitutes acceptance of the revised policy.
